Gregory Rich and Jonathan Berns obtained a verdict on behalf of a former Boeing employee who alleged that he was terminated because of his age during a reduction in force. Six other employees were laid off as part of the same reduction in force, and all the employees who were laid off were 53 years old or older. After a four-day trial, a jury found that age contributed to the decision to terminate the plaintiff and awarded him $700,000 in damages to compensate him for his lost income and emotional distress.
