Reinstatement Ordered for Fired Corrections Officer in Disability Discrimination Case

A judge has ordered the Missouri Department of Corrections to reinstate an employee who was fired from his job as a corrections officer in 2010 because of a disability. Jonathan Berns and Gregory Rich, the attorneys who obtained a jury verdict in favor of the corrections officer in June 2014, argued that reinstatement was necessary to restore the employee to the position that he would have held in the absence of the discriminatory conduct and to make him whole for his losses. The judge also awarded the employee nearly $185,000 for attorneys’ fees and court costs.
